LINGUAMEETING- POLICY FOR COMMUNITY STANDARS

IF YOU ARE A USING THE SERVICES OF LINGUAMEETING, THESE POLICIES FOR COMMUNITY STANDARDS (“POLICIES”) SHALL BE A LEGALLY BINDING ELECTRONIC CONTRACT BETWEEN YOU, WHICH INCLUDES THE COMPANY YOU REPRESENT AND THE COMPANY THAT REGISTERED YOU (COLLECTIVELY "YOU"), AND www.linguameeting.com OWNED BY LINGUAMEETING INC., WHICH INCLUDES ITS OWNER AND ASSIGNEES ("OUR", "WE", "US", OR "LINGUAMEETING") AND SHALL GOVERN YOUR USE OFLINGUAMEETING INC.'S SOFTWARE, WEBSITE, MOBILE APPLICATIONS OR CONNECTED APPLICATIONS OR OTHER OFFERINGS ON OUR WEBSITE (COLLECTIVELY, OUR "SERVICES"). THIS AGREEMENT SHALL BE DEEMED TO BE IN COMPLIANCE WITH ALL THE LAWS DEALING WITH ONLINE AND ELECTRONIC CONTRACTS. THIS AGREEMENT DOES NOT REQUIRE PHYSICAL SIGNATURE OF THE PARTIES AND SHALL BE A LEGALLY BINDING AND ENFORCEABLE CONTRACT BETWEEN THE PARTIES. BY USING ANY OF THE SERVICES OR CLICKING ON THE "SIGNUP" BUTTON, YOU AGREE TO BECOME BOUND BY THE POLICIES. IF YOU DO NOT AGREE TO ALL THESE POLICIES, CLICK ON THE "X" BUTTON AND DO NOT USE THE LINGUAMEETING SERVICES. LINGUAMEETING'S ACCEPTANCE IS EXPRESSLY CONDITIONED UPON YOUR ASSENT TO ALL THESE POLICIES, TO THE EXCLUSION OF ALL OTHER TERMS. IF THESE POLICIES ARE CONSIDERED AN OFFER BY LINGUAMEETING, ACCEPTANCE IS EXPRESSLY LIMITED TO THESE POLICIES.

You acknowledge and agree that, by accessing or using the site or services, or your LinguaMeeting account, or by posting any content on the site or otherwise, you are indicating that you have read, and that you understand and agree to be bound by, these Policies. if you do not agree to these Policies, then you have no right to access or use the site, services or collective content.

LinguaMeeting supports a free and open conversation environment among the coaches and the students. We are proud to facilitate conversational practice and cultural events through our platform.

Below is a guide to the standards of behavior we expect of all our users and coaches.

LinguaMeeting Sessions Moderation Principles

LinguaMeeting is dedicated to delivering authentic language practice/conversation to our users and coaches.

  • We bring together a diverse community of coaches to collaborate with students and faculty.
  • We view it as a great privilege to support faculty who entrust us with their students.
  • We are committed to providing our users with a welcoming, respectful and safe place to learn and practice their language skills.

I. LinguaMeeting Content Moderation Policy:

You are responsible for all Content that you post on the website. LinguaMeeting does not control and assumes no responsibility for such Content or any Content posted by other users.

LinguaMeeting reserves the right to moderate the activity on the platform and may remove or edit any Content for any or no reason, including, but not limited to, Content that, in LinguaMeeting's sole discretion, violates these Community Terms. LinguaMeeting may remove or edit such Content without prior notification to the responsible user.

Remember that use of the Community in conflict with any of the Terms may result in immediate termination or suspension of your accounts.

Please help LinguaMeeting to protect the integrity of the Community and to ensure that the Community remains as helpful as possible by reporting any inappropriate activity or user posts in the Community.

The Content Moderation Policy of LinguaMeeting is based on the following principles:

  • LinguaMeeting brings together a diverse community of people and provided a Platform to collaborate with each other.
  • We are proud that a variety of users repose their trust on us and entrust us with the responsibility to provide them with a safe and secure platform for communications, our users range from our roots in business to families and friends, to hospitals, legislatures, schools and universities.
  • We are constantly striving to ensure that we safeguard the free and open exchange of thoughts and ideas on LinguaMeeting.
  • We understand that we are in a position where we have a duty to take care for our users and the virtual and physical communities, and we conduct our duty with utmost dedication.

II. Abuse:

LinguaMeeting hereby expressly bars and condemns abuse in any form and with any user on the website. Any attempt to harass, intimidate, or silence someone else’s voice shall be considered as abuse and the account of the user who resorts to abuse may be permanently suspended.

III. Hateful conduct Policy:

Hateful conduct: You may not promote violence against or directly attack or threaten, harass or ridicule other people on the basis of race, ethnicity, national origin, caste, sexual orientation, gender, gender identity, religious affiliation, age, disability, or serious disease. We also do not allow accounts whose primary purpose is inciting harm towards others on the basis of these categories.

a. Hateful imagery and display names: You may not use hateful images or symbols in your communication on the website. You also may not use your username, or display name, to engage in abusive behavior, such as targeted harassment or expressing hate towards a person, group, or protected category.

b. Harassment: We expressly prohibit any kind of harassment in any manner on our platform, and the person who commits any such act shall be barred from using the services of LinguaMeeting permanently, and in extreme cases LinguaMeeting may resort civil or criminal remedies available under law.

c. Ridiculing: LinguaMeeting condemns every act of ridiculing others on the basis of race, ethnicity, national origin, caste, sexual orientation, gender, gender identity, religious affiliation, age, disability, or serious disease, and any such act of denigrating the self-esteem of others shall be treated with in a stern manner, and such person shall be permanently barred from using the services of LinguaMeeting, and in extreme circumstance LinguaMeeting may also resort to recourses available under law.

d. Abuse: We are committed to combating abuse motivated by hatred, prejudice or intolerance, particularly abuse that seeks to silence the voices of those who have been historically marginalized. For this reason, we prohibit behavior that targets individuals with abuse based on protected category.

e. Violent threats: We prohibit content that makes violent threats against an identifiable target. Violent threats are declarative statements of intent to inflict injuries that would result in serious and lasting bodily harm, where an individual could die or be significantly injured, e.g., “I will kill you.”

f. Incitement: We prohibit inciting behavior that targets individuals or groups of people belonging to protected categories. This includes content intended:

i. to incite fear or spread fearful stereotypes about a protected category, including asserting that members of a protected category are more likely to take part in dangerous or illegal activities, e.g., “all [religious group] are terrorists.”

ii. to incite others to harass members of a protected category on or off platform, e.g., “I’m sick of these [religious group] thinking they are better than us, if any of you see someone wearing a [religious symbol of the religious group], grab it off them and post pics!“

iii. to incite others to discriminate in the form of denial of support to the economic enterprise of an individual or group because of their perceived membership in a protected category, e.g., “If you go to a [religious group] store, you are supporting those [slur], let’s stop giving our money to these [religious slur].” This may not include content intended as political in nature, such as political commentary or content relating to boycotts or protests.

IV. Glorification of violence / Violent Threat Policy:

You may not threaten violence against an individual or a group of people. We also prohibit the glorification of violence.

Healthy conversation is only possible when people feel safe from abuse and don’t resort to using violent language. We define violent threats as statements of an intent to kill or inflict serious physical harm on a specific person or group of people.

Under this policy, you can’t state an intention to inflict violence on a specific person or group of people. We define intent to include statements like “I will”, “I’m going to”, or “I plan to”, as well as conditional statements like “If you do X, I will”. Violations of this policy include, but are not limited to:

a. threatening to kill someone;

b. threatening to sexually assault someone;

c. threatening to seriously hurt someone and/or commit a other violent act that could lead to someone’s death or serious physical injury; and

d. asking for or offering a financial reward in exchange for inflicting violence on a specific person or group of people.

This policy is enforced in tandem with our policies on abusive behavior and hateful conduct. Statements that express a wish or hope that someone experiences physical harm, making vague or indirect threats, or threatening actions that are unlikely to cause serious or lasting injury are not actionable under this policy, but may be reviewed and actioned under those policies.

V. Illegal or certain regulated goods or services:

We are always striving to consistently maintain a safe and secure online environment for our users, free from any violence and illegality. LinguaMeeting has very high regard to the law of the land, and we conduct our business with utmost compliance of laws, therefore, we hereby expressly prohibit the promotion, trade, or engagement of any of the following matters on LinguaMeeting platform:

  • Counterfeit goods and services;
  • Drugs and controlled substances;
  • Human smuggling or trafficking;
  • Products made from endangered or protected species;
  • Sexual services;
  • Gambling, betting or wagering activities;
  • Unauthorized multi-level marketing businesses;
  • Stolen goods; or
  • Weapons, including firearms, ammunition, and explosives, instructions on making weapons (e.g., bombs, 3D printed guns, etc.).

VI. Sensitive Content Policy:

You may not post media that is excessively gory or share violent or adult content within profile header, or List banner images. Media depicting sexual violence and/or assault is also not permitted.

We group sensitive media content into the following categories:

a. Graphic violence: Graphic violence is any media that depicts death, violence, medical procedures, or serious physical injury in graphic detail. Some examples include, but are not limited to, depictions of:

  • violent crimes or accidents;
  • physical fights;
  • physical child abuse;
  • bodily fluids including blood, feces, semen etc.;
  • serious physical harm, including visible wounds; and
  • severely injured or mutilated animals.

b. Adult content: Adult content is any consensually produced and distributed media that is pornographic or intended to cause sexual arousal. Some examples include, but are not limited to, depictions of:

  • full or partial nudity, including close-ups of genitals, buttocks, or breasts (excluding content related to breastfeeding);
  • simulated sexual acts; and
  • sexual intercourse or other sexual acts – this also applies to cartoons, hentai, or anime involving humans or depictions of animals with human-like features.

c. Violent sexual conduct: Violent sexual conduct is any media that depicts violence, whether real or simulated, in association with sexual acts. Some examples include, but are not limited to, depictions of:

  • rape and other forms of violent sexual assault, or sexual acts that occur without the consent of participants, including a simulated lack of consent; and
  • sexualized violence – inflicting physical harm on an individual within an intimate setting, where it is not immediately obvious if those involved have consented to take part.

d. Gratuitous gore: Gratuitous gore is any media that depicts excessively graphic or gruesome content related to death, violence or severe physical harm, or violent content that is shared for sadistic purposes. Some examples include, but are not limited to, depictions of:

  • dismembered or mutilated humans;
  • charred or burned human remains;
  • exposed internal organs or bones; and
  • animal torture or killing. Note: exceptions may be made for religious sacrifice, food preparation or processing, and hunting.

VII. Terrorism and Violent Extremism Policy:

We prohibit accounts that affiliate with organizations that use or promote violence against civilians to further their causes, either on or off the platform.

There is no place for terrorist or violent extremist groups on LinguaMeeting, or for those who affiliate with them or promote their activities.

  • We believe terrorist organizations are those groups subject to national and international terrorism designations.
  • We believe violent extremist groups are those groups that:
    • identify through their stated purpose, publications, or actions as an extremist group; have engaged in, or currently engage in, violence and/or the promotion of violence as a means to further their cause; and
    • target civilians in their acts and/or promotion of violence.
  • We will examine a group’s activities both on and off LinguaMeeting to determine whether they engage in and/or promote violence against civilians to advance a political, religious and/or social cause.
  • Some specific examples of prohibited conduct under this policy:
    • engaging in or promoting acts on behalf of a terrorist organization or violent extremist group;
    • recruiting for a terrorist organization or violent extremist group;
    • providing or distributing services (e.g., financial, media/propaganda) to further a terrorist organization’s or violent extremist group’s stated goals;
    • using the insignia or symbols of terrorist organizations or violent extremist groups to promote them.
  • If you are found to have violated this policy, you will be blocked from the LinguaMeeting platform. If you believe our finding is wrong, you can submit an appeal.

VIII. Private information:

LinguaMeeting strictly bars sharing of private information of any person on the website, without express consent of such person. Accounts that do so may be permanently suspended. Private information can include home address or physical location information, including street addresses, GPS coordinates or other identifying information related to locations that are considered private; identity documents, including government-issued IDs and social security or other national identity numbers; photo images of them; contact information, including non-public personal phone numbers or email addresses; financial account information, including bank account and credit card details; and other private information, including biometric data or medical records.

IX. Spam:

You may not use LinguaMeeting to spam anyone. Accounts that do so may be permanently suspended. Spam is generally defined as mass unsolicited or aggressive activity that attempts to manipulate or disrupt LinguaMeeting or the experience of LinguaMeeting users to drive traffic or attention to unrelated accounts, products, services, or initiatives.

X. Copyright, trademark, defamation, right of publicity, and impersonation:

Al the Trademarks and other Intellectual Property which are available on Linguameeting are the properties of LinguaMeeting or other authorized third parties, and they are protected by the Intellectual Property Laws of the country. While we are diligent to protect our own Intellectual Property and those of our authorized partners, we are also constantly striving to ensure that there is no Intellectual Property Rights infringed of any individual or organization on LinguaMeeting platform, therefore, we hereby expressly bar our users to upload or distribute content on LinguaMeeting that the users don’t have the right to transmit under any law, including trademark and copyright law, or under contractual or fiduciary relationships. We also believe in providing a safe and secure environment for our users and therefore any act of defaming others, impersonating anyone, or using another’s name or image without their permission, shall be dealt with in a stern manner, resulting in permanent suspension of the account of such users, and under extreme situations, LinguaMeeting may also initiate the recourses available under law to curb such commissions.

  • Copyright is a form of Intellectual Property, whereby, legal protection is accorded to the original artistic works of authorship, like books, movies, photos and music. The law of protection of copyrights expressly forbids the copying or displaying any work of authorship without permission, there are few exceptions to this general rule, most commonly fair use. “Fair use” is typically a use for criticism, comment, news reporting, teaching, scholarship, or research.
  • A trademark distinguishes the origin of products or services from one business to the other. Trademarks generally consist of one or more of the following (a). word, (b) logo, (c) phrase, or (d) design, sometimes the trademarks may also consist of non-tangible modes of representation like smell, music, or other such modes. Trademark law accords legal protection to the exclusive user of trademarks and prevents someone from using a trademark, which can create confusion, or likelihood of confusion about the origin of product or services.
  • Defamation (slander/libel) is to intentionally denigrating or defaming the reputation and goodwill of others by making false statements.
  • The “right of publicity” is using someone else’s name, persona, or image for marketing or advertising purposes without their permission.
  • Impersonation is intentionally taking the identity of others to extract some tangible or intangible enrichment.

XI. Reservation changes:

You can cancel up to 7 days before start time or within 24 hours of booking, or alter a reservation up to 72 hours before the experience begins.

XII. Refunds:

LinguaMeeting Experience users are elegible for a full refund if there are technical difficulties during the presentation that occur either in their own device or the coach/host’s device.
